These Terms of Service ("Terms") govern your use of the Apex Fitness application ("App") operated by Zero Deficit LLC ("Company", "we", "us", "our"). By using the App, you agree to be bound by these Terms.
By creating an account or using Apex Fitness, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the App.
Apex Fitness is a fitness and nutrition tracking application that provides:
IMPORTANT: Apex Fitness is a fitness tracking tool ONLY. It is NOT a medical device, and does NOT provide medical advice, diagnosis, or treatment. All calculations (BMR, TDEE, macros, E1RM) are mathematical estimates and should not be relied upon as medical guidance. Always consult a qualified healthcare professional, physician, or certified personal trainer before beginning any exercise program, changing your diet, or if you have any medical conditions.
BY USING THIS APP, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
(a) Physical exercise, including but not limited to weightlifting, resistance training, cardio, and mobility work, carries inherent risks of physical injury, including but not limited to muscle strains, ligament tears, fractures, joint injuries, cardiac events, and in rare cases, death;
(b) You voluntarily assume ALL risks associated with any physical activity you perform while using, or as a result of using, this App;
(c) You are solely responsible for your own physical condition and safety during any exercise or activity;
(d) Zero Deficit LLC, its officers, directors, employees, agents, and affiliates shall NOT be liable for any injury, disability, death, or any other damages — whether direct, indirect, incidental, special, or consequential — arising from or related to your use of the App.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZERO DEFICIT LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION: PERSONAL INJURY, BODILY HARM, LOSS OF DATA, LOSS OF PROFITS, OR ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Zero Deficit LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the App, violation of these Terms, or injury to yourself or others during physical activities.
We reserve the right to terminate accounts that violate these Terms. You may delete your account at any time via Settings, which triggers a full cascade deletion of all associated data within 30 days.
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration.
We may update these Terms at any time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance of modified Terms.
